Chedoke Creek Sewage Spill – Statement By Ward 8 Councillor John-Paul Danko

Hello Ward 8 Neighbours,

As has recently been reported, an undetected flow of combined stormwater and sewage was spilled into Chedoke Creek due to a partially open overflow gate at the King Street West Combined Sewer Overflow (CSO) Tank from January 28, 2014 to July 18, 2018.

As soon as the partially open gate was discovered, City staff immediately closed and secured the gate, reported the spill to the Ministry of the Environment and began cleanup efforts.

The following is a statement by City of Hamilton Ward 8 Councillor John-Paul Danko

As your Ward 8 City Councillor, my actions are governed by the Municipal Act. Regarding the incident in Chedoke Creek, I am unfortunately unable to discuss any staff recommendations, direction or deliberation that occurred during a closed session meeting without personal legal repercussion or censure.

This constraint is unsatisfactory to me and it should be unsatisfactory to the residents of Ward 8 and the City of Hamilton, but this is the extent of what I can legally say in relation to closed session meetings.

As a Licensed Professional Engineer (P. Eng.), my professional conduct is regulated by the Professional Engineers Act Code of Ethics which regards duty to public welfare as paramount, above duties to clients or employers.

As an elected Hamilton City Councillor, the municipal oath of office reaffirmed the importance of my responsibility to act ethically and uphold a position of trust.

However, I have one vote out of sixteen and I do not always agree with the majority direction.

I believe I have worked to the best of my abilities to uphold the obligations and ethics of my career as a Professional Engineer and my current role as the Ward 8 City Councillor. I am privileged to serve with senior Public Works leadership staff and City Manager, who I believe work to do the same.

After nearly a year serving on Hamilton City Council, my ethical obligations to the public good have been challenged more in this past year than my previous seventeen years working in the heavy civil construction industry.

As a Council, I realize that we have not achieved the standards expected of us by many residents of Hamilton, and it will take a renewed commitment to open and transparent municipal government to earn back your trust.
